Shades of grey or legal clarity? State intervention with BDSM relations between consenting adults

Research output: Contribution to journal › Article › peer-review

Abstract

In recent decades, there has been growing acceptance of unconventional sexuality, prominently exemplified by the book and film "Fifty Shades of Grey″, which portrays couples’ desire for sexual relationships involving acts of dominance, restraint, and pain encompassed under the acronym BDSM. These leisure practices or behaviours have recently begun to be studied more objectively and in greater depth, in tandem with their pathologisation being removed from the DSM-V. Unlike various forms of consent in conventional sexual relationships, consent within BDSM relationships serves as the cornerstone upon which the relationship is built, whether for a single session or a long-term partnership. This article proposes a reexamination of the state's right to intervene, through law enforcement, in consensual adult behaviours conducted in private. The authors argue that the state has no right to infringe upon individuals’ sexual freedom even when the exercise of such freedom results in physical injury, except in cases leading to severe injuries or death. Accordingly, they propose amendments to criminal law whereby, if the victim requested, urged, proposed, or consented to sexual behaviour that ultimately resulted in injury, their partner should be granted immunity from criminal liability.
