מחברי המאמר גורסים, כי ישנה בעייתיות בהפקדת שיקול הדעת בעניין חקירת עורכי דין, בידי קציני משטרה. לשיטתם, יש צורך בהפקדת הפיקוח המשפטי המקדמי בידי פרקליטי המחוזות.
