Abstract
בפסיקה בולטת לאחרונה מגמה חדשה של הגנה על הילד הנפגע על ידי הוריו. היא מעניקה זכות לילד לתבוע תביעת נזיקין את ההורה הפוגע בו, בין היתר, באמצעות גרימת נזק נפשי. הילד הנפגע יוכל לממש זכות זו ולתבוע את ההורה החב באחריות נזיקית כלפיו. המאמר דן במגמה חדשה זו ובעקרונות המשפט המשווה בעיקר בארה"ב
